General Description

Subscribers have access to the Awakening Tide on-line Group Subscription site (“Group Subscription Site”), which hosts a library of videos and articles, and the opportunity to participate in live video Group Sessions exclusively for Group Subscribers as delineated in each specific program or service purchased.

1. The Program fee is as listed in the service description.

2. All fees will be billed at the time of service.

3. Refunds are not available.

 

Group Subscription Terms and Conditions

In addition to the standard terms and conditions, Group Subscribers expressly agree to the following terms and conditions.

Term. Group Subscriptions are provided on a onetime basis with single payment.

Access. Access to the Group Subscription Site is provided exclusively to current Group Subscriber clients of The Awakening Tide. Subscribers may not use the Group Subscription Site for any purpose other than to participate in life coaching activities provided by the Awakening Tide. Subscribers may not use the Group Subscription Site for promoting or marketing other goods or services, or to collect data from other subscribers. The Awakening Tide reserves the right to cancel or restrict any person’s access to the Group Subscription Site if, in its sole discretion, the Awakening Tide determines that such person has violated any rules or terms of use or has otherwise inhibited or interfered with the coaching process established by the Awakening Tide.

Content. All video and written content available on the Group Subscription Site is the proprietary information of The Awakening Tide. Group Subscribers may copy, distribute, and adapt video and written materials for personal, noncommercial use, including posting on social media, so long as the Awakening Tide receives attribution as the creator of the materials.

Other Rights. You may have additional rights with regard to information gathered by the Group Subscription Site in accordance with the laws of your state of residence or the European Union.

 

 

 

**Group Coaching Terms of Service for Products that Include Group Coaching**

 

 

The Awakening Tide
Informed Consent for Group Telecoaching Sessions
including Consent to Record

 

The Awakening Tide (the “Awakening Tide”) offers group telecoaching sessions in an on-line format for its Group Subscribers (“Group Sessions”). This Informed Consent document provides information about the group coaching sessions and documents my consent to participate in the Group Sessions.

 

1. I, the undersigned Group Subscriber, understand that telecoaching services from The Awakening Tide are for my own discretionary use. I understand that The Awakening Tide and any affiliates are not in the practice of medicine and do not offer psychological services.

2. I, the undersigned Group Subscriber, understand group telecoaching is a service conducted over an on-line audiovideo platform determined by the Awakening Tide (the “Platform”).

3. Group Sessions are conducted by a life coach from the Awakening Tide, and include other Group Subscribers. I understand the participants and I will be in separate locations, communicating with each other live, in real time, over the Platform, during sessions that are scheduled in advance.

4. I understand that Group Sessions are different from individual sessions, and that the life coach guiding the Group Session has the discretion to establish guidelines and direct the subjects, the direction, and the tenor of the Group Session. I understand and acknowledge that the Awakening Tide reserves the right to limit, redirect, or cancel the participation of any person, including myself, if the life coach conducting the session determines that that person’s contributions to the group session are threatening, illegal, inappropriate, or otherwise in violation of any of the terms and conditions of participation.

5. I can decline to participate in Group Sessions at any time. If I decline, the Awakening Tide will inform me of other options provided by the Awakening Tide, if any.

6. I understand there may be technical difficulties involved in using the Platform or any telecommunications technology, including interruptions in on-line service, imperfect audio or video, and other technical issues. I understand that the Awakening Tide or I can discontinue a Group Session if problems with Platform prevent us from communicating effectively. If a session is cancelled or interrupted due to technical difficulties, the Awakening Tide may choose to reschedule the session, offer alternative services, or cancel the session without rescheduling, at its discretion. I have had sufficient opportunity to discuss any concerns about the Platform with the Awakening Tide. All of my questions have been answered to my satisfaction, and I expressly assume all risks associated with communicating over the Platform, including such Platform risks data leaks, unauthorized access, hacks, malware, and user error.

7. I understand that Group Sessions are offered to Awakening Tide Group Subscribers, that my existing client agreement applies to all Group Sessions, and that the terms of this consent form does not alter, and is in addition to, the terms of my existing client agreement.

8. I expressly acknowledge that the Awakening Tide may record group telecoaching sessions. By signing below, I hereby grant to the Awakening Tide and its successors and assigns the right to record my image and voice during group telecoaching sessions. Such recordings may be made on tape, film, or any digital medium, and in still, moving, or sound format. The Awakening Tide is further authorized to edit any such recording at its discretion. I expressly grant the Awakening Tide and its successors and assigns the right to use, and to allow others to use, my image and voice for the purpose of promoting or marketing the Awakening Tide’s mission, program, or classes, and for any other use advancing the benefit of the Awakening Tide, including use on social media. I hereby release the Awakening Tide, and its successors and assigns, from any and all claims I may have in connection with may now or may ever have with regard to any recording authorized hereunder.

9. I UNDERSTAND THAT GROUP SESSIONS ARE CONDUCTED WITH PEOPLE WHO MAY NOT KNOW EACH OTHER, AND WHO DO NOT NECESSARILY HAVE AN OBLIGATION TO MAINTAIN THE CONFIDENTIALITY OF STATEMENTS MADE BY OTHER PARTICIPANTS. ACCORDINGLY, I UNDERSTAND AND ACKNOWLEDGE THAT THE AWAKENING TIDE IS NOT ABLE TO PRESERVE MY PRIVACY AND CONFIDENTIALITY WITH REGARD TO GROUP SESSIONS, AND I HAVE NO EXPECTATION OF PRIVACY WITH REGARD TO MY PARTICIPATION IN GROUP SESSIONS.

10. The Awakening Tide may require me to update or renew my Informed Consent from time to time. I may revoke this Informed Consent at any time, by notifying the Awakening Tide in writing, but such revocation will not apply to my participation in any activities I undertook while this Informed Consent was in effect.

11. I been given the opportunity to ask any questions about this Informed Consent. I understand that I may ask further questions  by contacting my life coach at the Awakening Tide.

By signing this Informed Consent, I consent to participate in the Group Sessions (if purchased), certify that I understand the content to my satisfaction, and sign my name with the intent to be legally bound by the foregoing terms.
